Terms of Service

These Terms of Service ("Terms") are an agreement between you and Quotiva Solutions LLC ("Quotiva," "we," "us") governing your use of quotivaio.com and the Quotiva platform (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and for all activity under your account, and you agree to provide accurate information and keep it current.

2. Subscriptions, Free Trial & Billing

  • Free trials. We may offer a free trial on some plans. If your signup includes a trial, its length and terms are shown at checkout, and your payment method is charged when the trial ends unless you cancel before then.
  • Billing. Subscriptions renew automatically each billing period (monthly or annual) until canceled. Fees are charged to your payment method on file through our payment processor.
  • Cancellation. You may cancel at any time from your account settings. Cancellation stops future renewals; except where required by law, fees already paid are non-refundable and you retain access through the end of the period you paid for.
  • Price changes. We may change our pricing at any time. Price changes take effect at your next renewal.

3. Acceptable Use & Messaging Compliance

You agree not to misuse the Service, interfere with its operation, or use it for unlawful purposes. Because the Service includes calling, texting, and email tools, you are solely responsible for how you contact your own leads and clients, including:

  • Obtaining any consent required before calling or texting a contact, and honoring opt-outs promptly;
  • Complying with applicable communications laws and rules — including, in the United States, the TCPA, the CAN-SPAM Act, Do-Not-Call rules, and carrier/10DLC registration requirements;
  • Complying with all insurance licensing, advertising, and regulatory requirements that apply to your business.

We may suspend or terminate accounts that send spam, generate excessive carrier complaints, or otherwise violate this section.

4. Your Data

You own the contacts, messages, records, and other content you bring to or create in the Service ("Customer Data"). You grant us a limited license to host and process Customer Data solely to provide the Service. You are responsible for having the rights and consents needed for the Customer Data you use.

5. Third-Party Services

The Service integrates with third-party products (for example, dialers, calendars, payment processing, and carrier tools). Those services are governed by their own terms, may require separate subscriptions, and we are not responsible for their availability or conduct.

6. Our Intellectual Property

The Service — including its software, design, and branding — is owned by Quotiva and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service while your subscription is active.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. Quotiva is a software platform: we are not an insurance carrier, agency, or legal or compliance advisor, and nothing in the Service is legal, regulatory, or financial advice.

8. Limitation of Liability

To the maximum extent permitted by law, Quotiva will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the claim arose.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or fail to pay fees when due. Upon termination we will make your Customer Data available for export for a reasonable period, after which it may be deleted.

10. Governing Law & Changes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be communicated by email or in the Service, and continued use after they take effect constitutes acceptance.
